-A proof of quorum was established by the fact that there
were 123 proxies versus the 19 required per By-Laws. Also present were the Hubers and Reggie
Romine.
-Ron Candido presented the Treasurer’s report for Kim
Scott. The ending balance was $2136.65 the report was accepted.
- The 2009 budget was presented by Ron Candido. The budget was accepted.
-Ron Candido presented the President’s report.
-Old business: There was none.
-Reggie Romine made a motion to elect
Ron Candido, Kim Scott, John Rew and Dick Brazda. It was seconded by Debbie Huber. Motion passed unanimously.
-Develop a more comprehensive list
of e-mails by adding request to newsletter.
-Ron Candido will follow-up on a
date for the yard sale and publish in the Spring
-Investigate moving the annual
meeting to a place were food could be served as an incentive for attendance.
-Follow-up on properties needing
repair or attention.
-Follow-up on rental properties to
make sure they are registered with the City.
LAKESHORE ASSOCIATION BOARD MEETING
10 February 2011
Ron Candido called the meeting to order at 7:10 p.m. He stated
that the Lakeshore Association currently has 196 dues paying members.
To have a quorum 10% of membership has to be present either in
person or by proxy. There were 84
present by proxy and 12 members in attendance.
Ron Candido asked for sign-in of attendees and personal
introductions of those attending the meeting.
The Treasurer’s
Report was given by Kim Scott.
A question was asked regarding $0.00 for postage. It was explained this was due to the
purchase of envelopes already stamped with postage.
that are used for newsletters and other necessary Association
correspondence. So it was listed under miscellaneous (as stationary).
A question was asked about the insurance. Ron Candido explained how it covered
Board Members and Liability for the Park.
Recommendation for approval by Robi Rew and seconded by Joan
Spivey. Report was approved.
President’s
Report for 2010 presented by Ron Candido.
The following topics were discussed.
1.
Leaves: If there was
any established guideline regarding yard maintenance
of fallen leaves. Especially
when one neighbor doesn't maintain their yard
and weather conditions blow them into your
yard. No specific item
addresses this problem.
2. Recent water
flow from front entrance landscaping island was do to a
cracked fitting in the sprinkler system which has been repaired.
3. Agreed to contracts for landscaping
costs.
4. Held annual
meeting February 2010. Discussion
about number of
attendees.
5. Planted
flowers at entrance. One complaint
entered regarding height of
flowers. It was stated an individual could not see over them in
order
to make a right turn. It will be
inspected in the spring and may be cut
back in the Fall if found to be an
obstruction.
Ron was thanked by all members for his outstanding and generous
work in maintaining the development entrance
landscaping.
6. Decorated
front entrance for Christmas.
7. The Liberty
Lane entrance to Lakeshores is registered with
Keep Vermillion County Beautiful and will continue to be maintained.
Ron Candido stated that we have had periodic trash in the street such
as Busch Lite cans. He
has collected approximately 1/4 bag of trash/year.
8. Welcomed 5
new homeowners to our association.
This is a good sign
due to recent economic conditions.
9. Furnished dues
releases to local realtors. It was
stated that realtors
are to mention the Association when showing a
home. This is sometimes
not done and regular notices are sent to make
realtors aware
advise potential buyers of dues and regulations.
10. Collected past dues for 52 Shorewood Point. Discussion was
given how in the
past there was no established way to ensure payments.
It is now established that annualdues must be
paid within 90 days.
Until paid, an additional $10.00 per month, will be assessed to
property owner. Non-payment could have end
result of lien on
the home. This was recently enforced when a
homeowner refused
to pay dues during the years they lived in Lakeshore. A lien was
put on the home and when sold, the Association
collected all
annual dues and penalties.
11. Painted Park Benches.
12. Trees were trimmed on the West Side of the Park to improve
lake view. Wild
flowers have been allowed to grow down the side
of the hill
towards the water. This is to
curtail erosion.
13. Replaced sections of split rail fence on North side of park.
This included an additional, permanent
section where the
asphalt drive led down to the water.
14. Removed graffiti on park benches and stop signs.
Ron Candido recommended that if homeowners encounter
graffiti, to use water or denatured alcohol to remove it.
Lake Shore
Homeowners Association Budget for 2011 CY was introduced for discussion by Ron
Candido.
Items discussed in
order. Grounds maintenance estimate was increased in anticipation of tuck pointing
repair needed for front entrance brickwork.
Bill Black mentioned the cost and difficulty he incurred when
having the bricks on his chimney repaired. When the development was
established,
the brick used was an inferior brick and crumbles more easily than
other types of brick.
Several members offered to look into names of individuals or
contractors and convey them to Ron for estimates.
Election
of Board Members was introduced.
Names of current
board members who were up for re-election was presented.
Attendees were asked if there were any other nominations. There
was no response.
Approval to re-elect current board members up for re-election was
motioned by Bill Black and seconded by Donna Westfall.
It passed by a voice vote.
The discussion was
opened to questions, suggestions or general topics by all attendees.
The following were discussed:
* Lake Shore Annual Yard Sale: If sufficient interest was given, a date
which would not conflict with other neighborhood sales would be
established.
Another opportunity at establishing a neighborhood wide sale would
be promoted. A past yard sale
was used to
generate funds that provided a new play set for the Association
park.
* Ron Candido stated he has been in contact with Landlords of
rental property concerning care of units and specific problems in the
neighborhood.
Recent events where a fight, gun and police on Lakeshore South was
mentioned and the action Ron took to alert police of armed weapon on the
property in question.
Two to three years ago, there had been some break-ins and
currently there have been some events but overall the neighborhood is a safe
and desirable area in which to live.
Individuals were asked to be aware of their surroundings, strange
observances and report anything of concern. The local Neighborhood Watch had been
turned over to
a new individual and it is hoped that, when the weather improves,
a neighborhood meeting could be held at the park for all that are
interested.
* Robi Rew asked about by-laws, permits and construction approval
plans. Question was put forth about
individuals and whether plans were submitted for board approval and local
permits obtained.
Ron Candido stated that he had a list of all permits where work
was done in the neighborhood.
A question was put forth regarding the meaning of 'extensive
landscaping' and requiring a board approval.
It was explained that the placement of hedges and fences were of
concern in the event that they might detract from property value or obstruct
view due to road/property perspective.
Public Right of Way
starts in the center of the road and could run up to 10 feet of individual
property. This had to be considered
when landscaping.
Robi Rew mentioned having a situation where a neighbor removed
several trees and after the phone line was cut, discovered that J.U.L.I.E. had
not been called.
The business removing
the trees was just above two gas lines and the city had to be called to make a
formal inspection due to this transgression.
Ron Candido and Bill Black also mentioned, in the beginning of the
development, many trees were planted and property owners encouraged not cutting
down any if possible.
Over time, the trees
have aged and personal views of trees have altered the landscapes of many
yards.
Whether the Board had a right to determine if a property owner
could/could not cut down a tree. It
was stated that this could be considered
a liability against the board in the event a future accident
happened in regard to the request.
Property owners must be aware of their rights and liability in making
this decision.
It would not be
decided by the board.
Mentioned was the overgrowth of certain evergreen bushes at the
development entrance. Ron Candido
stated he would look into the problem.
* Entrance sign was recently painted.
* An inquiry was made if a listing of all Lakeshore residents and
email address would be available to members.
Discussion determined that due to privacy and safety concerns, any
request for information could be made to Ron Candido.
* Request for Association Handbook (received) and mention that it
was available on-line on the Association Web site.
* Mention was made regarding individuals joy-riding over private
property in their vehicles during this recent snowfall.
Bill Black stated that in the past it had been mentioned to him
that if an individual put deterrents on their property and an accident
resulted, the property owner could be found liable.
Mention was made of a
property in the neighborhood that used very large landscaping stones around the
edge of their property to prevent further damage.
Years ago, the
development had its own security that patrolled the area. Individuals were requested to be
observant and contact appropriate individuals when suspicious behavior was
suspected.
Homeowners leaving their garage doors open for long periods of
time could draw unwanted interest, especially if they have a lot of property that
could be seen in the garage
* A question regarding planned work on the Shorewood Point water
stations was brought up by Robi Rew.
Plans are for work to be done this year. A question was put forth regarding
property lost due to the city claiming eminent domain was asked.
Referral to Dave Schnelle or Doug Aherns was recommended for
further questions.
* Question posed regarding breaking of the noise ordinance and if
the association had any power to take action against an individual property
owner.
It was stated the police had to catch the individual in person and
tracking times could help to get police in the area most likely when the
problem would happen.
The same went for uncontrolled dog barking.
* A clarification of association handbook rule was requested. It was noted that permanent above ground
pools are prohibited,
but could smaller
pools be erected for a couple months during the summer and then removed. It was found that there was no objection
to this in the handbook.
Ron Candido asked if any further matters needed to be
discussed. None were stated and
motion to adjourn was given by Mike Westfall and seconded by Kim Scott.
